REGULATIONS OF THE SERVICE www.warrington.store effective as of 01.09.2024.

 

§ I. DEFINITIONS

 

1. Whenever the following terms are used in these Terms and Conditions, they shall be understood as:
a. Form - the order form made available on the Website.
b. Entrepreneur - a natural person, a legal person or an organisational unit which is not a legal person, having legal capacity, conducting business activity, including under non-registered activity, in accordance with separate regulations.
c. Goods - all products presented on the Website.
d. Class A Goods - new and in working order packed in undamaged or slightly damaged original packaging.
e. Class B Goods - used and working goods in damaged packaging, original packaging or replacement packaging.
f. Class C goods - goods that may be damaged, inoperable.
g. Service - an organised Internet platform consisting of websites and other Internet tools made available via the Internet, available at: www.warrington.store.
h. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between Warrington and the Ordering Party at a distance via the Service.
i. User - any person using the Website and the services available through the Website;
j. Orderer - a non-consumer entrepreneur within the meaning of the Consumer Rights Act of 30 May 2014, who makes an Order on the Website directly in connection with his/her business or professional activity.
k. Order - a declaration of will of the Ordering Party, aiming directly at concluding a Sales Agreement, directly related to his/her economic and professional activity, specifying in particular the type and number of Goods.
 

§ II. GENERAL PROVISIONS

 

1. The administrator of the www.warrington.store website is Warrington Kryszkiewicz Spółka komandytowa, NIP 5252733130 5 Racjonalizacji St., 02-673 Warsaw (hereinafter the ‘Administrator’).
2. These Terms of Service (hereinafter referred to as ‘Terms of Service’) define the principles of electronic provision of services by the Administrator and constitute, by means of the Website operating under the address www.warrington.store, the regulations of electronic provision of services within the meaning of the Act of 18 July 2002 on electronic provision of services.
3. Each User is obliged to familiarise himself/herself with the content of the Rules and Regulations before using the Service. In order to use the order form and/or the contact form, the User must confirm that he/she has read the Rules and Regulations, accepts them and undertakes to comply with them.
4. Information about the Goods given on the Website, in particular their descriptions, technical and usable parameters and prices, constitute an invitation to conclude an agreement, within the meaning of Article 71 of the Civil Code.
5. Prices of Goods placed on the Website are given in Polish zloty and include all components, including VAT, customs duties and any other components.
 

§ III. ELECTRONIC SERVICES

 

1. The Administrator shall enable Users to use the following electronic services:
a. reading materials prepared by the Administrator and third parties and made available by the Administrator on the Website;
b. asking questions using forms available in the Service and anonymous chat;
c. making orders through the Service according to the rules defined in these regulations.
2. Use by a User of the services referred to in sec. 1 lit. a) and b) is free of charge. The service referred to in point c) is chargeable on the principles indicated in the Regulations.
3. In order to use the services of the Website it is necessary for the User to have a device with access to the Internet and a web browser enabling the display of web pages.
4. The Administrator reserves the right to make technical interruptions in making the Service available.
5. The Administrator is not responsible for:
a. the way in which the Users use the Website or for any consequences resulting therefrom;
b. information downloaded from the Website, nor for the consequences of their use by Users, nor for their usefulness to the Users;
c. errors in the operation of the Website which are independent and not attributable to the User;
d. . damages caused by causes independent and not attributable to the Administrator, in particular due to force majeure;
e. For damages incurred by the User caused by dangers occurring on the Internet, in particular hacking into the User's system, interception of passwords by third parties, infecting the User's system with viruses.
 

§ IV. RULES OF USING THE ONLINE SHOP

 

1. Registration on the Website is a prerequisite for using the Website.
2. Registration takes place by completing and accepting the registration form made available on the Website.
3. Registration is conditional on agreeing to the content of the Terms and Conditions and providing personal data marked as mandatory.
4. The User may unregister from the Service at any time, without stating any reason and without incurring any costs, by sending WARRINGTON via e-mail to office@warrington-it.pl or in writing to WARRINGTON's postal address indicated in the Terms of Service, a request to delete the account, together with an indication of the e-mail address (address) currently registered on the Service.
5. The services offered through the Service are directed exclusively to Entrepreneurs, who are not consumers within the meaning of the Consumer Rights Act of 30 May 2014, and therefore only such an entity may register on the Service.
6. WARRINGTON may delete any account registered on the Service or restrict access to it to part or all of the resources of the Service, with immediate effect, in the event that the User violates the Terms and Conditions, and in particular if it is suspected that the User:
a. provided, during registration on the Website, data which are untrue, inaccurate or outdated, misleading or infringing the rights of third parties;
b. has used the Website to infringe the personal rights of third parties, in particular the personal rights of other Website Users;
c. shall behave in any other way that WARRINGTON deems inconsistent with applicable law or general Internet usage rules, or violates WARRINGTON's good name.
7. A User whose account has been deleted under the procedure referred to in section 6 above may not register again without WARRINGTON's prior consent.

 

§ V. DISTANCE SALES

 

 1. In order to conclude a Sales Agreement via the Website, the User must go to the website www.warrington.store, register or log in to his/her account and then select the products, taking subsequent technical actions based on the messages displayed and information available on the website.
2. The Orderer's selection of the Goods to be ordered is made by adding them to the shopping cart.
3. During the process of placing the Order, until the ‘Order and pay’ button is pressed, the Orderer has the possibility of modifying the data entered and with regard to the selection of the Goods. To do so, follow the messages displayed and the information available on the website.
4. The Ordering Party is obliged to make a statement confirming that he/she is placing the Order as a Business Entrepreneur who is not a consumer within the meaning of the Consumer Rights Act of 30 May 2014. In the Order, the data must be provided truthfully. The person who filled in the documents is fully responsible for the truthfulness of the data entered.
5. Once the Ordering Party has provided all the necessary data, a summary of the Order placed will be displayed. The summary of the Order placed shall contain information concerning:
a. the subject of the Order;
b. the unit and total price of the ordered products or services, including delivery costs and additional costs (if any), together with all applicable taxes and other components;
c. the chosen method of payment
d. the chosen method of delivery;
e. the delivery time.
6. In order to send an Order, it is necessary to accept the content of the Terms and Conditions, provide personal data marked as mandatory and press the ‘Order and pay’ button. The Order placed through the Website entails the obligation to pay.
7. The Orderer's sending of the Order constitutes a declaration of will to conclude a Sales Agreement with WARRINGTON, in accordance with the content of the Regulations.
8. After placing an Order, the Ordering Party shall receive an e-mail message containing a final confirmation of all material elements of the Order, including a conditional confirmation of receipt of the Order, conditional on the Administrator's receipt of payment.
9. If the Administrator does not receive payment within 30 working days from the date of placing the Order, the Order shall be deemed withdrawn by the Ordering Party. The Administrator shall send information about acceptance of the Order as withdrawn to the e-mail address provided by the Ordering Party.
10. The Administrator shall not be liable for any errors made by the Ordering Party when placing an Order, in particular errors in delivery address and/or contact details.
11. After placing an Order and fulfilling the requirements referred to in the preceding paragraphs, the Administrator sends the Goods to the address specified in the form with instructions and a receipt or VAT invoice.
12. The Administrator may refuse to execute a placed and unpaid Order if:
a. the data provided by the Ordering Party is incomplete;
b. he/she has justified concerns that:

  • the data provided by the Ordering Party is incomplete, incorrect or untrue, or
  • The order was placed as a result of unauthorized interference in IT systems;
  • The order will not be paid despite the Ordering Party's declaration that it will be paid "on delivery".

13. Until the Goods are shipped, the Ordering Party may withdraw the order by sending an appropriate declaration to the e-mail address: office@warrington-it.pl from the address indicated in the order form. The Administrator will confirm receipt of the declaration immediately after receiving it, but no later than within 1 business day.

 

§ VI. DELIVERY

 

1. Delivery of the Goods shall not be limited to the territory of the Republic of Poland and shall take place to the address indicated by the Ordering Party in the course of placing the Order.
2. Delivery of the ordered Goods shall be made by courier service, via DPD, DHL or Inpost courier. The detailed costs of delivery are indicated when placing the Order.
3. The delivery period is up to 14 working days counting from the day the Customer sends the Order and pays for it.
4. The Administrator shall not be held liable for any delay in delivery resulting from circumstances beyond its control. The Administrator shall inform the Customer of any such delay.
5. Goods purchased under the Order shall not be subject to returns and exchanges.
 

§ VII. COMPLAINTS/ WITHDRAWAL FROM THE CONTRACT/ WARRANTY

 

1. Complaints concerning the functioning of the Service should be submitted by e-mail to: office@warrington-it.pl or by post to: Warington Kryszkiewicz Sp.k. NIP 5252733130 5 Racjonalizacji St., 02-673 Warsaw
2. Notification of a complaint should include the identification of the person submitting the complaint (name, surname, address, e-mail address) and a description of the event giving rise to the complaint.
3. The Administrator will consider the complaint within 14 days of its receipt. The Administrator reserves the right to extend the above-mentioned term, however by no more than 14 days, in case the consideration of the complaint requires unusual, special actions and arrangements or encounters obstacles independent and not attributable to the Administrator (equipment failures, Internet network, etc.).
4. The Administrator stipulates that consideration of a complaint may require obtaining additional explanations from the User - the time of providing such explanations by the User each time extends the period of complaint recognition.
5. The answer to the complaint shall be sent to the User at the address provided by the User in the complaint. In the absence of an address, the reply to the complaint shall be sent to the address indicated in the order form.
6. The Administrator shall not be liable for the consequences of improper use of the Goods not in accordance with the instructions and intended use.
7. The purchase through the Website is excluded for consumers within the meaning of the Act of 10 May 2014 on Consumer Rights, therefore the Ordering Party who has concluded the Sales Contract is not entitled to withdraw from the contract referred to in Article 27 of the aforementioned Act.
8. Pursuant to Article 558 § 1 of the Civil Code, the Administrator excludes the Purchaser's rights under the warranty for defects in the Goods.
 

§ VIII. FINAL PROVISIONS

 

1. The Administrator reserves the right to amend the Terms of Service. Amendments to the Terms of Use shall become effective upon their publication on this website, unless stated otherwise.
2. The User's use of the Website after amendments to the Terms and Conditions have been introduced shall be deemed to constitute acceptance thereof.
3. The Terms and Conditions in a single document in PDF format are always available in the current version for download at: www.warrington.store.
